Fetchcondos.com ("Fetchcondos," "we," "us," "our") maintains a database of the documents that Florida law entitles a prospective purchaser to receive, at the seller's expense, before the resale of a residential condominium unit — currently the eight documents listed in section 718.503(2)(a), Florida Statutes:
We also track the condominium governance form that section 718.503(2)(b) entitles a purchaser to receive. The Legislature amends these requirements regularly, so the database follows section 718.503(2) as amended from time to time.
We build and maintain this database by reaching out to the parties who hold these documents — sellers, listing brokers, property managers, and associations — and organizing what we collect so that it's available, association by association and property by property, to real estate brokers who register for the platform.
Fetchcondos is a database and retrieval service. We are not a real estate brokerage, title company, property management company, or association, and we do not draft, approve, or certify the documents in our database. We collect them from the party responsible for them and make them available to you.
By registering for or using Fetchcondos, you agree to these Terms. If you're registering on behalf of a brokerage, you're confirming you have authority to bind that brokerage to this agreement.
Fetchcondos is available to licensed real estate brokers and their authorized agents and transaction staff who register an account. There is no fee to brokers for accessing the document database or using the core service. You must be at least 18 years old and registering in a professional real estate capacity. If fulfilling a request requires paying a charge set by a third party — for example, an association's or manager's document preparation fee — we'll show you the pass-through amount before you confirm the request, and you authorize us to collect it on that party's behalf. We don't mark up pass-through charges.
You're responsible for keeping your login credentials secure and for activity under your account. If you believe your account has been compromised, contact us right away at support@fetchcondos.com.
When you pull a document for a property from Fetchcondos, a few things are true:
If a document you need isn't yet in the database for a given property, you can request that we obtain it, and we'll reach out to the relevant parties the same way we do to build the database generally.
Building this database means we come into possession of a substantial amount of information: property and association details, financials, board member and property manager names, and more — much of it about people who have no account with Fetchcondos and never asked to be in our system. We're stating plainly how we use it, rather than leaving it to a privacy policy you might skip.
We intend to use this data, in aggregated, de-identified, or property/association-level form, to build data products, reports, and datasets that we sell or license to third parties. This is a separate line of our business from the free database service brokers use, and it's how we fund maintaining the database at no cost to you. Buyers of that data may include real estate technology companies, lenders, insurers, data aggregators, and researchers.
What this means in practice:
- We don't sell or repackage sensitive items that occasionally show up in a document — financial account numbers, payment credentials, or Social Security numbers stay restricted to the purpose of maintaining the document itself.
- Everything else we collect in the course of building or updating the database may be used the way this section describes.
Details on this, including rights available to people whose information appears in our documents but who aren't Fetchcondos users, are in our Privacy Policy, which is part of this agreement.
To keep the database accurate and the service trustworthy, you agree not to:
We may suspend or terminate an account that violates these rules — typically with a warning first, immediately for serious violations like fraud or misuse of third-party data.
Anything you personally create on the platform — notes, uploaded files you authored, messages — stays yours; you're granting us a license to host and use it to run the service. Documents in our database belong to whatever rights structure the originating association, property manager, or seller has in them; we're not claiming ownership over a condominium association's bylaws just because we host a copy. The data we extract from those documents is subject to Section 4 above.
The Fetchcondos name, logo, and site design belong to us — please don't use them outside the product without written permission.
Fetchcondos is provided as-is and free of charge to registered brokers. We're not a law firm, brokerage, title company, or association manager, and nothing here is legal or transactional advice. We disclaim, to the fullest extent the law allows, implied warranties like merchantability or fitness for a particular purpose.
Because the substance of the documents in our database comes from third parties, we're not responsible for errors, omissions, or outdated information in a document, and we're not responsible for a transaction outcome — including a missed closing or a disclosure dispute — that traces back to a document being stale, incomplete, or wrong.
Because Fetchcondos doesn't charge brokers a fee for the core service, our total liability for any claim arising from your use of the platform is limited to the greater of $100 or the amounts you paid through the platform in the 12 months before the claim arose. We're not liable for indirect or consequential damages.
If a third party brings a claim against Fetchcondos because you broke these Terms, misused documents or data obtained through the platform, or violated a law or someone's rights while using it, you agree to indemnify us — meaning you'll cover the losses, damages, and reasonable legal fees that claim causes us. We'll notify you promptly of any such claim, and you may participate in its defense at your own expense. This section doesn't apply to the extent a claim results from our own breach of these Terms.
Most documents in our database are association governing documents, financial reports, and related materials collected from the party responsible for them. If you hold rights in a document we host and believe we shouldn't be hosting it, email support@fetchcondos.com with a copy or description of the document, the property or association it relates to, and the basis for your request. We'll review promptly and remove or restrict access where appropriate.
For copyright claims specifically, send a notice that satisfies 17 U.S.C. § 512(c)(3) to our designated agent at support@fetchcondos.com. We follow the DMCA notice-and-takedown process, and we may terminate accounts of repeat infringers.
You can close your account any time from your settings, or by emailing support@fetchcondos.com. We can suspend or terminate accounts that break these Terms, as described in Section 5.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes arising under these Terms will be handled exclusively in the state and federal courts located in Florida.
We may update this agreement as the platform and the underlying statute evolve. If a change is material, we'll email you and post an in-app notice at least 30 days before it takes effect. Continued use of the platform after that date means you've accepted the update.
If a court finds part of these Terms unenforceable, the rest stays in effect. These Terms and the Privacy Policy are the entire agreement between us about the platform and replace any earlier discussions or representations. You can't assign your rights or obligations under these Terms without our written consent; we may assign ours in connection with a merger, acquisition, or sale of assets, and we'll notify you if we do. If we don't enforce a provision right away, we're not waiving it. Neither of us is liable for delay or failure caused by events beyond reasonable control, except for payment of pass-through charges already incurred.
